"Health Is Important": Supreme Court Won't Interfere In Delhi Cracker Ban

'Health Is Important': Supreme Court Won't Interfere In Delhi Cracker Ban

The Delhi government had put a comprehensive ban on firecrackers.

New Delhi:

The Supreme Court on Wednesday refused to interfere with the Delhi government’s order putting a comprehensive ban on manufacturing, storage, sale and bursting of firecrackers in the city, saying people’s health is important.

BJP Lok Sabha member Manoj Tiwari told a bench of justices AS Bopanna and MM Sundresh that a complete ban was imposed on firecrackers despite the court allowing bursting of green firecrackers.

“No, we are not going to interfere. Where the government has banned firecrackers, it means complete ban. People’s health is important. If you want to burst firecrackers, go to states where there is no ban,” the bench told advocate Shashank Shekhar Jha, appearing for Mr Tiwari.

The counsel said his client being an MP was responsible towards his constituency and the court has itself allowed bursting of green firecrackers.

“People burst firecrackers during wedding and victory processions after elections, then why can’t they be allowed to burst green firecrackers during festivals,” Mr Jha said.

He said that even the top court and a Calcutta High Court verdict of last year said there will not be a complete ban on bursting of firecrackers.

“You should make the people understand that they should not burst firecrackers. Even you should not burst firecrackers during victory processions after elections. There are other ways of celebrating the victory,” the bench told Mr Tiwari, who is an MP from North East Delhi.

The Delhi government had put a comprehensive ban on firecrackers for the third year in a row starting from 2021.

Mr Tiwari has filed a petition last year challenging the complete ban on bursting of firecrackers in Delhi and cited that in various other states people are allowed to burst them.

However, the top court last year refused to accord urgent hearing on Tiwari’s plea saying, “Let the people of Delhi breathe clean air. People should not spend money on firecrackers instead they should eat sweets.” On September 11, to combat high pollution levels during winter months, Delhi’s Environment Minister Gopal Rai announced a comprehensive ban on the manufacture, storage, sale and bursting of firecrackers in the capital city.

The sweeping directive of the Delhi government includes the prohibition of online sale of firecrackers, comes ahead of the festival season. A similar blanket ban was imposed during the last two years.

During the hearing, the bench asked Delhi Police to formulate by Thursday, its argument that despite complete ban on sale of firecrackers in Delhi, how they will regulate and implement the guidelines of the Centre on bursting of green firecrackers.

During the hearing, Additional Solicitor General Aishwarya Bhati, appearing for the Centre and other government agencies like Central Pollution Control Board and Petroleum and Explosives Safety Organisation (PESO) said that they have been continuously implementing the directives of the top court on green firecrackers and have put a mechanism in place to check sale and manufacture of normal firecrackers.

Bhati placed on record the regulatory mechanism for green firecrackers quality control which included random sample checking from markets and factories and their examination in labs, putting up encrypted QR code on each box of firecrackers, so that entire composition details and approvals can be viewed.

The bench told Bhati, “All these labs, random checking and monitoring are okay but we want to know how these new guidelines are being implemented on the ground and what is the mechanism and penalty for violations.” The ASG said besides random checking and monitoring being done by designated officers, penalties include cancellation and suspension of license to manufacture and sale of firecrackers.

“We have a complete mechanism with safeguards in place. Presently fireworks manufacturers are manufacturing products with 30 per cent emission reduction in particulate matter vis-a-vis conventional fireworks products manufactured prior to Supreme Court order dated October 23, 2018 (by which ban was imposed on conventional firecrackers),” she said, adding that periodic review of emission standards are undertaken.

Bhati said that a separate affidavit has been filed by PESO giving details of regulatory mechanism which have been put in place and said that the court may issue appropriate directions, if required, so that this problem of pollution from firecrackers can be settled once and for all.

Senior advocate Gopal Sankaranarayanan, appearing for a group of minors who filed the main petition in 2015 seeking complete ban of firecrackers in Delhi, said that he is not pressing the main prayer for complete ban but seeks direction for adoption of graded response.

“I am not looking for a complete ban but I am looking for a graded response to the problem of pollution due to firecrackers. Children are dying left, right and centre. Houses are being burnt due to firecrackers and people are suffering from injuries,” he said, adding that due to pollution in Delhi, there are reports that lungs of children less than five years old are turning black due to deposits of particulate matter, which should be pink in colour.

On August 31, observing that regulations become a “mockery” if not implemented, the top court has asked the Centre and regulatory bodies like PESO to apprise it of measures taken to strengthen the protocols to ban production and sale of non-green firecrackers across the country.

Firecracker manufacturers have told the top court that expert bodies like PESO, CPCB and the National Environmental Engineering Research Institute (NEERI) have dealt with the issue of green crackers and now quality control was the only thing remaining to be addressed. The CSIR-National Environmental Engineering Research Institute (CSIR NEERI) has defined green crackers as firecrackers made with a reduced shell size, without ash, and/or with additives such as dust suppressants to reduce emissions.

The top court had in October 2021 said though there was no blanket ban on use of firecrackers, those containing Barium salts will remain prohibited.

While issuing several directions, it had said celebrations cannot be at the cost of the health of others and warned that top officials at various levels shall be held “personally liable” for lapses.

Blog: Blog: Behind The Scenes – Covering G20 Summit For NDTV

5 am in the morning. I was in such a state of excitement that I couldn’t sleep a wink the previous night. I had to report to the Jawaharlal Nehru Stadium to catch a shuttle to Bharat Mandapam on Day 1 of the G20 summit.

When I got there, an equally sleep-deprived Vishnu Som, our Executive Editor, joined me as we started our G20 coverage.

As a television producer tasked with covering this event, I had the privilege of witnessing first-hand the process of bringing insights, discussions, and debates to screens worldwide through our anchors and video journalists.

The design of the workplace reflected the G20 theme, with working areas segmented into sections named after Indian rivers – Ganga, Yamuna, Brahmaputra, Krishna, and Godavari. On the first floor, we had Narmada, Indus, and Kaveri.

Months before the event, meticulous planning and research were imperative. Understanding the themes, key speakers, and potential newsworthy moments allowed us to design compelling, non-stop 60-hour coverage on TV and the website. This involved liaising with our team, which includes editors, reporters, camera crews, and engineers, to ensure everyone was aligned with the objectives of uninterrupted programming.

Securing access to the event was a crucial step. This involved navigating accreditation procedures, and travel arrangements, and ensuring all equipment needed, tested, and checked. Coordination with the G20 authorities, event organizers, and security personnel resulted in smooth operations during the event.

The G20 is a dynamic environment with impromptu discussions, interviews, and press conferences around every corner of the International Media Centre. In my role as a producer, my capacity to adapt quickly to unexpected developments was vital. My camera team, Pooja Arya, Azam Siddiqui, and Ashok Mahale, were always ready to capture the most relevant and engaging content possible.

But then last-minute problems always crop up. A very senior anchor forgot his bag in the Bharat Mandapam shuttle on Day 2 of the Summit. It had his ID cards and documents. Thankfully he was wearing his Bharat Mandapam ID card and managed to get in. We later recovered the bag much to everyone’s relief.

Among the highlights of the G20 coverage were the exclusive interviews with prominent figures like India’s G20 Sherpa Amitabh Kant, Chief Coordinator of the summit Harsh Shringla, South African President’s spokesperson Vincent Wagmenya, and World Bank Chief Ajay Banga to name a few. Anchors Vishnu Som, Parmeshwar Bawa, and Vasudha Venugopal prepared thoughtful, important, and incisive questions.

Technology can be a double-edged sword in such a dynamic setting. Adverse weather conditions, like rain on Day 2, made us switch our broadcasting to indoors, and crowded press conference venues were the main challenges for me and the camera team to do the setup in a very short span of time. Rigorous testing and having backup solutions in place were essential. A shoutout to our engineer Ashish Kumar who was on a call away to help us navigate any crisis. Additionally, leveraging cutting-edge technology, such as high-quality streaming via Live U Units and high-speed in-house internet at the media centre helped us uplink our footage on time.

After every event, the real work began at our headquarters – assembling and editing the footage into segments. Meeting tight deadlines while maintaining the highest production standards was a challenging but rewarding aspect of the process. Details of the video feeds, transcripts, and photographs were constantly shared on a WhatsApp group so that everyone was on the same page.

Covering G20 as a television producer is a multifaceted endeavor that requires meticulous planning, adaptability, and a deep understanding of the event’s significance. It was a privilege to be part of a team that brought this global dialogue to our viewers worldwide. I want to take a moment to express my heartfelt gratitude to Devna Dwivedi, Chief Executive Producer, NDTV Group, for giving me the opportunity to cover the historic event. It was an invaluable experience that I will always cherish.

Piyush Chawla praises performance of India’s top order in Asia Cup

Colombo: Lauding the recent starts by Rohit Sharma and Shubhman Gill, Indian leg break spinner Piyush Chawla has backed the Indian opening pair despite criticism of their misfiring in the initial matches of the ongoing Asia Cup.

Rohit and Shubman failed to provide an ideal start to Men in Blue in the opening match of the Asia Cup group stage match against Pakistan.

Gill struggled to time his shots throughout his innings while Rohit departed off Shaheen Afridi’s wonder delivery. But after that game, both openers never looked back and laid the foundation for the middle-order batters to work their charm in games against Nepal, Pakistan and Sri Lanka.

“If you look at Rohit or Shubman, you want a good start from your openers and they are providing it. They won against Nepal by 10 wickets, even against Pakistan they provided a good start, they laid the foundation for KL Rahul and Virat Kohli. You can’t say that the top order is not doing anything, the top order is playing well and they are firing,” Chawla said while speaking exclusively to ANI.

The experienced spinner further went on to point out that the Indian team looks balanced, they are playing a good brand of cricket and their last two games served as examples of it.

“The way the team is playing, it is exceptionally good. The team looks balanced and it is enjoyable to watch them. Against Pakistan, we put up a huge total on the scoreboard, and our batting fired up there. In the previous match against Sri Lanka, the pitch was tricky. The bowlers were under pressure without the cushion of many runs, but the way bowlers defended the low total was amazing,” Chawla added.

After sealing their spot in the final, India will now look to keep their unbeaten streak alive against Bangladesh on Friday in their final game of the Asia Cup Super four Clash.

Iran: European Parliament’s ‘interventionist’ positions hurt relations

The spokesman for Iran’s Foreign Ministry has denounced as “interventionist” the recent anti-Tehran remarks by some European Parliament members, urging the EU not to allow such statements to hurt bilateral relations and the course of dialogue between the two sides.

In a statement on Wednesday, Nasser Kan’ani said remarks by some EP members regarding Iran’s domestic issues show European politicians act under the influence of misinformation campaigns or at best biased consultations provided to them.

He specifically cited “unsubstantiated allegations” regarding prisoners in Iran and the country’s institutions. Those remarks were made in a meeting convened to assess the situation in Iran following the 2022 death of an Iranian girl named Mahsa Amini and the ensuing unrest.

Western states have time and again accused Iran of cracking down on “peaceful protests” in the country.

But Iran says the unfortunate death of Amini, which was caused by her illness, was used as an excuse for widespread rioting enabled by several foreign intelligence agencies and that the country had to act to protect public order by confronting the rioters.

EP’s positions damaged Iran-EU ties

Kan’ani said the EP’s anti-Iran positions over the last year indicate the insistence of some European Parliament members on pursuing a confrontational stance towards the Iranian people and government.

“These positions and remarks are in line with the continuation of a failed policy towards the realities of Iran’s society and people, and also show their unpreparedness and confusion in the face of Iran’s resilience, rationality and authority of the Islamic Republic of Iran,” he said.

The Iranian official said employing logic of interventionism and resorting to “futile” political and propaganda pressure tactics further reveals the “lack of seriousness as well as insincerity” of some people in Europe in pursuing the policy of interaction with Iran.

The Iranian spokesman urged the European Union not to allow its institutions to make such “unconstructive and baseless” remarks that complicate their “purported efforts” to keep dialogue with Iran.

“The anti-Iran positions of the European parliament over the past year have to a great deal damaged the Iran-EU relations. We hope these people learn a lesson from their failures in understanding Iran’s developments in recent years, come to realize the realities soon and make up for such untrue positions and remarks,” he said.

The European Parliament has taken various anti-Iran moves over the past years that have drawn objections from Iran.

Back in November, in an undiplomatic move, lawmakers in the European Parliament cut direct contact between European Parliament delegations and committees with official Iranian counterparts” over what they claimed to be Iran’s “unacceptable” sanctioning of several members of the house.

The lawmakers further voiced support for foreign-instigated rioters, saying, “We will not look away from those who look to us on the streets of Iran. We are with you. We will stay with you.”

Moreover, earlier that month, the European Union imposed sanctions on a number of Iranian institutions and individuals, including Press TV, over alleged “rights violations” following the recent foreign-backed riots in the country.

Also in October, the EU foreign ministers decided to levy sanctions against several Iranian individuals and entities over the country’s response to the foreign-backed riots.

A week later, Iran announced tit-for-tat sanctions against institutions and individuals in the EU due to their deliberate actions in support of terrorism and terrorist groups.

This comes as the EP in May hosted the ringleader of the anti-Iran terrorist cult the Mujahedin-e-Khalq Organization (MKO) which has murdered thousands of Iranian citizens to discuss the foreign-backed riots in Iran.

Also, the parliament in January adopted a resolution that called for designating Iran’s Islamic Revolution Guard Corps, a branch of the country’s armed forces, as a terror group.

'Like Washing Clothes In Dhobi Ghat": Gavaskar Sums Up India's Win vs Pak

Asia Cup: Like Washing Clothes In <i>Dhobi Ghat</i>": Sunil Gavaskar Sums Up India-Pakistan Super 4 Match

“Just as you wash clothes in a dhobi ghat”: Sunil Gavaskar on India’s win vs Pakistan.© Instagram

Former Indian cricket team captain Sunil Gavaskar was elated after the Rohit Sharma-led side hammered Pakistan by 228 runs in an Asia Cup Super 4 clash on Monday. Virat Kohli and the returning KL Rahul scored unbeaten centuries as India posted a total of 356/2 in 50 overs. In reply, Pakistan were bowled out for a paltry total of 128, with Kuldeep Yadav taking a five-wicket haul. Gavaskar likened India’s big win over Pakistan to a washerman thrashing clothes at a laundry bay.

“Forget about the biggest victory, puri tarah se dhula diya (we just hammered them), just as you wash clothes in a dhobi ghat. If you are a good team, you don’t let the result of the previous match affect you. If they think too much about it, they won’t be able to concentrate on the next match. I don’t expect Pakistan to make such a mistake,” Gavaskar said on India Today.

While Rahul silenced his doubters in his appearance since May, Jasprit Bumrah was also a force to reckon with, especially with the new ball.

Gavaskar was content to see Bumrah and Rahul back to full fitness.

“KL Rahul not only scored a century but also kept wickets. He made a big statement amid all the talk about his fitness. He proved that he is completely fit. Jasprit Bumrah, too, looked in great rhythm. His run-up looked good, and he swung the ball both ways. Even a world-class batter like Babar Azam was unable to play him,” he added.

After the match was moved to the reserve day, Kohli top-scored with an unbeaten 122 while Rahul (111) announced his comeback with his 6th hundred in ODIs.

Kohli now has 47 ODI centuries to his name, only to less than India great Sachin Tendulkar, who holds the record with 49 tons.

Ryanair Passenger To Get Rs 27 Lakh As Compensation After She Fell On 'Narrow And Steep' Plane Steps

The woman filed a suit against the airline and asked for $33,595 in compensation.

Ryanair has been ordered to pay $33,000 (approximately Rs 27 lakh) to a passenger after she broke her leg in two places while stepping off the plane,  El Periodico reported.

The unnamed woman was flying with the Irish budget airline from Seville to Alicante in Spain to meet her newborn grandson in February 2020, when the incident happened. The woman fell while exiting the aircraft, rolling all the way down the staircase from the second step, the Spanish newspaper reported.

The woman was taken to hospital for surgery, she had broken her tibia and fibula. She was hospitalised for three days.

The woman filed a suit against the airline and asked for $33,595 in compensation.

As per El Periodico, the judge at the Commercial Court of Seville said that Ryanair plane’s staircase “was especially narrow and steep.”

Another report from Europa Press said that the woman received slightly less than the requested money as the compensation for accommodation and pharmacy expenses was rejected.

Meanwhile, Ryanair chief executive Michael O’Leary was hit with a pie in the face by environmental protesters in Brussels earlier this month. According to the BBC, the airline chief was preparing to speak outside European Union headquarters when two female protesters dressed in black smeared him with two cream pies.

"India's First Electric Highway's Pilot Project In Nagpur": Nitin Gadkari

'India's First Electric Highway's Pilot Project In Nagpur': Nitin Gadkari

“Electric highway is very very economically viable,” said Nitin Gadkari. (File)

New Delhi:

The government is working on developing electric highways as it is economically viable, Union Road Transport and Highways Minister Nitin Gadkari said on Wednesday.

Nitin Gadkari has earlier said that making India’s first electric highway between Delhi and Jaipur is his dream.

“My idea about the electric highway is that NHAI will give right of way…Today, I had a discussion with the Power Ministry, I am trying to get electricity at the rate of Rs 3.50 per unit, otherwise, the commercial power rate is Rs 11 per unit,” Nitin Gadkari said at the ACMA annual session here.

The minister noted that it is easy for the power ministry to give electricity to a government company at a cheaper rate.

“Electric highway is very very economically viable…I will give all the rights to private sector investors who are going to invest (in the electric highway project),” he added.

Nitin Gadkari further said that electric cable construction will be executed by private investors and NHAI will charge an electric tariff just like toll.

Electric highways cater to electric traction for vehicles in the same manner as is done for railways. This is based on prevalent technology in a large number of countries like Sweden and Norway.

This involves the provision of power cables, which can be utilised by a vehicle which caters to this type of technology. The vehicle will utilise the power from this cable for its traction. At present, the ministry is evaluating various technologies.

“We are making the first electric highway pilot project in Nagpur,” he said.

The minister also pointed out that India is the fastest growing major economy, and the automobile sector is the pride for India.

According to Nitin Gadkari, the size of the automobile industry currently is Rs 12.50 lakh crore, up from Rs 4.15 lakh crore in 2014, when he took charge as the road transport and highways minister.

Noting that the import of fossil fuel is constantly increasing, he said it is time for the country to find a solution to this crisis.

2 Army Officers, Policeman Killed In Action In Kashmir, Encounter On

Col Manpreet Singh, Major Aashish Dhonchak and DSP Himanyu Muzamil Bhat were killed in action

Srinagar:

A colonel, a major of a Rashtriya Rifles unit of the army and a Deputy Superintendent of Jammu and Kashmir Police were killed in action during an encounter with terrorists in Jammu and Kashmir’s Anantnag district, officials said.

Colonel Manpreet Singh, Major Aashish Dhonchak and Deputy Superintendent of Police Himanyun Muzamil Bhat were killed in action during the gunfight. Colonel Manpreet Singh was the commanding officer of the 19 Rashtriya Rifles (19 RR) unit.

Rashtriya Rifles is the counter-insurgency force of the army that operates in Jammu and Kashmir.

The body of the police officer has been retrieved amid heavy firing by terrorists in the dense forests of the Kokernag area of Anantnag.

Lt Gen Rajiv Ghai, Army’s 15 Corps commander and Director General of Jammu and Kashmir Police Dilbag Singh are among the top officials who have rushed to the encounter site to supervise the operation and evacuation of bodies.

The Cheetah helicopters of the army have been pressed into action for surveillance and evacuation operation at the encounter site.

Sources say a joint operation was launched by the army and police late last night after they received specific information about the presence of terrorists.

The troops led by the commanding officer and a deputy superintendent of Jammu and Kashmir police came under heavy firing.

The three officers were critically injured. Reinforcement was immediately rushed to the area but due to heavy firing from terrorists, who are believed to be well entrenched, the injured couldn’t be evacuated immediately, sources said.

This is the second encounter in the last 24 hours. Earlier one army soldier was killed in action and three security forces personnel were injured during a fierce encounter with terrorists in Jammu and Kashmir’s Rajouri district, police said.

Two terrorists were also killed in the encounter. The operation is still underway.
