US Urges Appeals Court To Reject Trump's Immunity Claim In 2020 Election Case

Washington:

U.S. prosecutors on Saturday urged a federal appeals court to reject former President Donald Trump’s claim that he cannot face criminal charges for seeking to overturn his defeat in the 2020 election.

Special Counsel Jack Smith, who is overseeing the prosecution, argued in a court filing that nothing in the U.S. Constitution or American legal tradition supports giving former presidents “absolute immunity” from criminal charges for action taken while in office.

Smith said creating such a legal shield would place presidents above the law.

Trump has claimed that the presidency is “cloaked with absolute immunity” from prosecution, Smith said. “He is wrong.”

Smith argued that the separation of powers mandated by the constitution and legal precedent make clear that a former president can be charged for crimes he committed while in the White House “including, most critically here, illegal acts to remain in power despite losing an election.”

Trump, the frontrunner for the Republican presidential nomination in 2024, is appealing a lower court ruling denying his bid to dismiss the election charges based on his claim of immunity. His lawyers argued in a Dec. 23 filing that allowing Trump to be charged for conduct related to his official responsibilities would undermine the presidency.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit is scheduled to hold arguments on the matter on Jan. 9.

Trump, president from 2017-2021, has pleaded not guilty to charges that he defrauded the United States, obstructed Congress and violated the civil rights of voters through schemes to overturn his loss to Democrat Joe Biden. The case is one of four criminal prosecutions Trump faces and one of two that relate to his alleged efforts to subvert the 2020 election.

Trump, frontrunner for the Republican presidential nomination, has accused prosecutors of a politically motivated effort to damage his campaign for the Nov. 5, 2024 election. State-by-state contests to select a nominee begin on Jan. 15.

The timing of the court’s decision is seen as crucial to whether Trump will stand trial beginning in March as scheduled. Progress in the case has been halted while the immunity appeal remains pending.

Smith earlier this month asked the U.S. Supreme Court to bypass the lower appeals court and immediately decide the issue, in an attempt to stave off Trump’s attempt at delay.

The Supreme Court denied the request, leaving the issue for now with the D.C. Circuit court.

Thousands in Melbourne call for ceasefire in Gaza

Tens of thousands of demonstrators gathered outside of Melbourne’s State Library Victoria to speak in defence of Palestine on Saturday. 

Footage shows protesters marching, holding Palestinian flags and signs reading: ‘One child is too many! But 11,500…? Stop bombing kids’ and ‘More than 100 Palestinian children killed by Israel every day. Why are you silent,’ among others, and chanting: ‘Israel, USA, how many kids did you kill today?’ ‘In the thousands, in the millions, we are all Palestinians!’ 

One of the organizers stated that for two consecutive weekends, about a hundred thousand people participated in their demonstrations in support of Palestine. She added that all protesters ‘have been the embodiment of the values that the Palestinian cause and that this movement raises to defend’ such as humanity, freedom, justice and equality. 

“The Australian people see images of children being killed; families being torn apart. They see kids without parents being discharged from a hospital with no home to go to. And they want our government to lend its support and its strength to end the bombing, to end the killing, and we want the same,” a protester was quoted by AFP as saying.  

Thousands of demonstrators has been gathering in Melbourne for twelve weeks in a row, supporting people of Gaza and demanding a lasting ceasefire and the fundamental rights of freedom and self-determination for the Palestinian people. 

Israel declared a ‘complete siege’ of Gaza, with a large-scale campaign of air strikes. A ground incursion began at the end of the third week, with Israeli leaders vowing to ‘wipe out’ Hamas. Palestinian officials reported that over 21,000 people had been killed and more than 55,000 injured at the time of publication. 

The Israeli Defence Forces (IDF) claimed that Hamas locations and infrastructure were targeted in the response. However, United Nations experts warned against ‘collective punishment’ for the people of Gaza, before predicting a ‘humanitarian crisis’ and then claimed that ‘hell is settling in for the region.

A 17-year-old girl was allegedly kidnapped and raped for 10 days here, police said on Saturday.

The girl was rescued on Saturday and the 30-year-old accused has been arrested, police said.

On the morning of December 18, the girl left her house for college but did not return. Her brother lodged a police complaint on December 19, a police officer said.

Rajesh Dubey was arrested from Prayagraj district and booked under sections 363 (kidnapping), 366 (inducing to compel for marriage), and 376 (rape) of the Indian Penal Code and the POCSO Act.

Mumbai:

A 40-year-old man allegedly killed his 35-year-old wife and injured his elder brother over a property dispute in suburban Malad in Mumbai, police said on Saturday.

The accused, identified as Dreson Dasa, is on the run and five teams have been formed to nab him, an official said.

The crime came to light on Friday afternoon when the wife of the injured man, Damian Dasa, returned home from the market.

The complainant woman found her husband Damian Dasa and Chitra Dasa lying in a pool of blood, following which they were rushed to hospitals after informing the police, the official said.

Damian was found alive but Chitra was declared dead by doctors, he said.

As per the preliminary investigation, Dreson attacked Chitra and Damian with a flower pot and a baseball bat over the sale of a residential property.

Based on the FIR lodged by Damian’s wife, a case of murder and attempt to murder has been registered against Dreson.

Police have formed five teams to nab him, the official added.

Australia head coach Andrew McDonald on Saturday showered praise on David Warner and said that he is probably the greatest all-format Aussie player. Speaking to cricket.com.au ahead of the third Test match against Pakistan, McDonald said that Warner’s retirement from the Test format would be a great loss for the Aussie squad. The Aussie head coach added that it would be hard to find the left-handed batter’s replacement. “In time, he will probably go down…but probably at the moment as it sits, he is probably our greatest ever all-three format player. He is going to drop out of one of those formats in terms of Test match cricket. He will be a loss. I know that people have been gunning for him for a period of time, but for us internally, we have seen the great value in what he brings to the table, hence why we have kept picking him. He repaid a bit of that faith in the first Test match. He’s going to be hard to replace. Someone who strikes at 70 averaging 45, and most ever runs as an Australian opener,” McDonald said.

Talking about Australia’s performance in 2023, McDonald said they had a successful year.

“…It is been a long 12 months, we have had a successful 12 months. So we will be able to sit back at the end of that and celebrate as a team, the success that we have had, another series win here. Burundi’s President Evariste Ndayishimiye has called on citizens to stone gay people, escalating a crackdown on sexual minorities in a country where LGBT people already face social ostracism and jail terms of up to two years if convicted of same-sex offences.

“If you want to attract a curse to the country, accept homosexuality,” Ndayishimiye said in a question and answer session with journalists and the public held in Burundi’s east on Friday.

“I even think that these people, if we find them in Burundi, it is better to lead them to a stadium and stone them. And that cannot be a sin,” he said, describing homosexuality as imported from the West.

His comments were the latest show of widening intolerance of LGBT people in the region.

Uganda passed a law in May that carries the death sentence for certain categories of same-sex offences and lengthy jail sentences for others – a move that was widely condemned by Western governments and human rights activists.

The United States has imposed a range of sanctions including travel restrictions and removing Uganda from a tariff-free trade deal. The World Bank also suspended all future loans to the east African country in protest.

Some lawmakers in Kenya, South Sudan and Tanzania are pushing for similarly tough anti-gay laws in their countries.

The politicians in these countries see their efforts as buttressing African values and sovereignty against what they view as Western pressure on the issue.
