Nagpur: Maharashtra Deputy Chief Minister Devendra Fadnavis had not concealed information about two pending criminal cases against him in the affidavit for 2014 assembly elections intentionally or with an intent to win polls, a court here said while acquitting him.

Civil Judge Sangram Jadhav on September 8 acquitted Fadnavis in a complaint lodged against him for alleged non-disclosure of two criminal cases pending against him in the poll affidavit.

The detailed order of the court became available on Monday.

The court stated that Fadnavis had not concealed information about the two pending cases intentionally.

It noted that section 125A of the Representation of Peoples Act (RPA) does not impose strict liability upon the accused and it is necessary to prove his mens rea that is the intention to hold him guilty.

If a candidate’s source fails to gather some information then for that mistake the candidate should not be held responsible. The court also noted that in the present case, Fadnavis took the help of an advocate to gather details of all the criminal cases pending against him.

“On the contrary, it is an unjust and unreasonable expectation that the accused (Fadnavis) or layman leaving all his work and business wander door to door of various courtrooms to gather information about criminal cases pending against him,” the court said.

It added that Fadnavis had mentioned about 22 pending cases, which are of a more serious nature, against him in the election affidavit and that no fruitful purpose would be served to Fadnavis by hiding the two criminal cases which were inconsequential of nature.

Satish Uke, an advocate, had filed the application seeking criminal proceedings against Fadnavis alleging that cases of cheating and forgery had been registered against the BJP leader in 1996 and 1998 but he did not disclose this information in his poll affidavit.

Fadnavis submitted to the court in April this year that the non-disclosure was an inadvertent mistake on the part of his previous lawyer.

The senior BJP leader had stated there was no intention to deliberately conceal information about the two insignificant complaint cases and their non-inclusion in the affidavit of Form 26 was sheer inadvertence and without any intention.

Fadnavis had appeared before the court on two occasions to record his statement.
Uke is presently in jail after he was arrested by the Enforcement Directorate on charges of money laundering.

In 2014, when Uke’s complaint was heard for the first time, the civil court had ruled against Fadnavis but the Nagpur bench of the Bombay High Court gave him clean chit.

Uke challenged the HC order before the Supreme Court which held that a case was made for the prosecution of Fadnavis.

The apex court set aside the HC judgment and remanded the matter for a fresh trial.
Fadnavis later filed a review petition against this order, which the top court dismissed in 2020.

A native of Annaram village in Kotapalli mandal, Rajashekhar is the son of Shankar and Jaya. He was selected as a constable with the police department in 2018. While working with the department, he appeared for an examination and physical efficiency tests held for recruitment of sub-inspectors.

Iran’s Deputy Foreign Minister for Political Affairs Ali Bagheri Kani says the Islamic Republic welcomes any initiatives proposed by the European Union to open new doors of interaction and cooperation, reiterating the country’s resolve for bilateral engagement with the bloc.

Bagheri Kani, who is also Iran’s chief negotiator, made the remarks in a meeting with Luigi Di Maio, EU Special Representative for the Persian Gulf region and his accompanying delegation in the capital Tehran on Sunday.

He went on to say that Iran’s capacities in the regional and international arenas “have presented irreplaceable opportunities for regional and global players to hold dialogue, interaction, and cooperation.”

Bagheri Kani further underlined that Iran in practice has shown that it has the necessary determination and ability to hold bilateral interaction, while referring to the role of the European Union in mobilizing and consolidating the capacities of Europe.

Therefore, he said, Tehran welcomes any initiative from the European side to boost cooperation and interaction.

Di Maio, for his part, acknowledged Iran’s important and effective role in regional and global developments, emphasizing that all EU member states support dialogue and interaction with the Islamic Republic.

Di Maio, a former Italian foreign minister was appointed as the EU’s first envoy for the Persian Gulf region in May. The EU official also met with Iranian Foreign Minister Hossein Amirabdollahian in Tehran earlier in the day.

Southampton: Reduced to 8/3 in the fifth over, World Champions England came roaring back to post a decent total and then bowl out New Zealand for 147 to win by 79 runs the rain-truncated second One-day International at the Rose Bowl here on Sunday.

All-rounder Liam Livingstone hammered an unbeaten 95 off 78 balls and shared a 112-run partnership with fellow white-ball expert Sam Curran (42) as England reached a respectable total of 226/7 in 34 overs.

The hosts continued with the momentum with the ball too as they kept New Zealand under pressure, claiming the last five wickets for 28 runs to bundle them out for 147 and seal a 79-run win and level the four-match series 1-1.

With rain reducing the match to a 34-overs-each affair, England landed into trouble straight away after being inserted in by New Zealand captain Tom Latham on winning the toss.

The hosts lost Jonny Bairstow (6), Harry Joe Root (0) and Ben Stokes (1) to the pace and guile of seasoned Trent Boult, who returned to the squad after a break and soon rattled England. And when in-form young star Harry Brook (2) was caught by Allen off Matt Henry, England were in dire straits at 28/4.

Skipper Jos Buttler scored a 25-ball 30 but was castled by Mitchell Santner, making it 55/5. And when Moeen Ali was sent back to the pavilion for 33, the hosts were 103/8 in the 21st over.

Livingstone and Curran came together for their vital partnership and turned things around for England.

Livingstone hammered nine boundaries and one six in his 78-ball unbeaten 95 and with Curran blasting a 35-ball 42, England raced to 215/6 when Curan was sent packing by Tim Southee.

Livingstone, who completed his fifty off 47 balls, survived a DRS review by New Zealand in the 28th over and helped England reach a defendable total.

In their reply, New Zealand lost opener Finn Allen for zero, bowled by David Willey off the second ball of the innings and though Devon Conway and Will Young took them to 49 in the ninth over, they continued to lose wickets at regular intervals.

Daryl Mitchell scored 57 off 52 balls to attempt a rescue act but he lacked support from his players who succumbed to England’s disciplined attack. For England, pacers David Willey (3-34) and
Reece Topley (3-27) were the top wicket-taker.

New Delhi: Gold prices on Wednesday fell by Rs 15 to Rs 59,228 per 10 grams in futures trade as speculators reduced their positions.

On the Multi Commodity Exchange, gold contracts for October delivery traded lower by Rs 15 or 0.03 per cent to Rs 59,228 per 10 grams in a business turnover of 12,028 lots.

Analysts attributed the fall in gold prices to the trimming of positions by participants.

Globally, gold was trading 0.10 per cent lower at USD 1,950.70 per ounce in New York.

Hyderabad: The iconic Osmania University Arts College is all set to be lit-up with a theme-based laser light and sound show, which will be launched on Tuesday.

Dubbed as dynamic lighting system, the laser show will showcase the OU’s rich history and its contribution in various fields on the façade of the Arts College. The content will strive to outline the entire history of the OU including the agitations that took place between 2001 and 2014 for statehood.

According to sources, the show in Hindi has voice over of Bollywood actor Ajay Devgn, while Tollywood actor Rana Daggubati lent his voice for the Telugu version.

The laser show with a runtime of 30 minutes will comprise of two shows and will be organised on weekends. The show will be inaugurated by union Minister for Culture, Tourism and Development of Northern Eastern Region G Kishan Reddy along with Ministers V Srinivas Goud, Talasani Srinivas Yadav and OU Vice Chancellor Prof. D Ravinder.

Wellington: Batter Kane Williamson made his return to the New Zealand side as the Blackcaps announced their squad for the ICC Cricket World Cup 2023 in India from October 5 onwards on Sunday night. In the pursuit to go one better than their Final appearance in 2019, New Zealand have named their 15-player group for this year’s ICC Men’s Cricket World Cup.

New Zealand confirmed the group at Papatoetoe High School in Auckland on Monday, the alma mater of leg-spinner Ish Sodhi, who was named in the squad.
The 30-year-old joins skipper Kane Williamson, who was confirmed as a squad member this week after making a quicker-than-expected recovery from a ruptured ACL at the 2023 Indian Premier League (IPL). Both Williamson and fast bowler Tim Southee have been named to appear at their fourth World Cup.

Following a strong run in form across the two white-ball formats, Mark Chapman has earned his spot, as well as 23-year-old spin-bowling all-rounder Rachin Ravindra, who claimed 3/48 against England in the first of four ODIs on Friday.

There was no room in the group for young top order batter Finn Allen, nor back-up wicket-keeper Tim Seifert, with the Black Caps opting for Tom Latham as the sole wicket-keeper in the squad. New Delhi: Investors will get faster settlement and they will have faster cash in hand with SEBI’s plan of one-hour trade settlement, said A Balakrishnan, Executive Director of Geojit Financial Services.

“We do not see any impediment in Sebi’s plan to implement one-hour settlement of trades first. It is highly implementable when Clearing Corporations and Depositories are ready with the systems. UPI’s success created confidence in near real time settlement,” he said.

“Investors will get faster settlement and they will have faster cash in hand. It is like having an UPI where transactions are settled quickly. It will mark a significant leap in transparency and efficiency in the Indian stock market offering investors real time access to their assets which will further attract resident investors in our stock market,” he added.

Rishi Agrawal, CEO and Co-Founder, Teamlease RegTech said the change is great news for investors. In the T+1 settlement cycle, liquidity becomes available in a couple of days. With the hourly settlement, this cycle will be further crunched, making capital market investments even more attractive. In addition, the change will also free up a significant chunk of margin money that brokers maintain with the clearing corporation.

However, the regulatory reporting obligations of the key market participants, such as brokers, clearing corporations, depository institutions, and fund houses, will be affected. They must modify their technology systems from an end-of-day batch processing mode to hourly processing, he said.
