Nagpur: Maharashtra Deputy Chief Minister Devendra Fadnavis had not concealed information about two pending criminal cases against him in the affidavit for 2014 assembly elections intentionally or with an intent to win polls, a court here said while acquitting him.

Civil Judge Sangram Jadhav on September 8 acquitted Fadnavis in a complaint lodged against him for alleged non-disclosure of two criminal cases pending against him in the poll affidavit.

The detailed order of the court became available on Monday.

The court stated that Fadnavis had not concealed information about the two pending cases intentionally.

It noted that section 125A of the Representation of Peoples Act (RPA) does not impose strict liability upon the accused and it is necessary to prove his mens rea that is the intention to hold him guilty.

If a candidate’s source fails to gather some information then for that mistake the candidate should not be held responsible. The court also noted that in the present case, Fadnavis took the help of an advocate to gather details of all the criminal cases pending against him.

“On the contrary, it is an unjust and unreasonable expectation that the accused (Fadnavis) or layman leaving all his work and business wander door to door of various courtrooms to gather information about criminal cases pending against him,” the court said.

It added that Fadnavis had mentioned about 22 pending cases, which are of a more serious nature, against him in the election affidavit and that no fruitful purpose would be served to Fadnavis by hiding the two criminal cases which were inconsequential of nature.

Satish Uke, an advocate, had filed the application seeking criminal proceedings against Fadnavis alleging that cases of cheating and forgery had been registered against the BJP leader in 1996 and 1998 but he did not disclose this information in his poll affidavit.

Fadnavis submitted to the court in April this year that the non-disclosure was an inadvertent mistake on the part of his previous lawyer.

The senior BJP leader had stated there was no intention to deliberately conceal information about the two insignificant complaint cases and their non-inclusion in the affidavit of Form 26 was sheer inadvertence and without any intention.

Fadnavis had appeared before the court on two occasions to record his statement.
Uke is presently in jail after he was arrested by the Enforcement Directorate on charges of money laundering.

In 2014, when Uke’s complaint was heard for the first time, the civil court had ruled against Fadnavis but the Nagpur bench of the Bombay High Court gave him clean chit.

Uke challenged the HC order before the Supreme Court which held that a case was made for the prosecution of Fadnavis.

The apex court set aside the HC judgment and remanded the matter for a fresh trial.
Fadnavis later filed a review petition against this order, which the top court dismissed in 2020.

Jaipur: A woman and her two children, aged three and one, died in a fire at a house in Rajasthan’s Sri ganganagar district on Monday, police said, suspecting it to be a case of suicide by her.

The incident took place in an area under the Rajiyasar police station, they said.
Prima facie, it appears to be a case of suicide, Rajiyasar Station House Officer (SHO) Satyanarayan Godara said and added that traces of kerosene have been found at the house.

He said that only the woman and her children were in the house during the time of the incident. The deceased have been identified as Jyoti Rajput, Sarthak (3) and Mohit (1), police said.

The bodies have been kept at a hospital mortuary and the postmortem will be conducted on Tuesday morning, Godara said.

He said that at present no case has been registered in this regard. The case will be registered on the basis of information from the victim’s relatives, the official said.

New Delhi: More than 1.67 crore cases, which include about 32.27 lakh pending cases and about 1.35 crore pre-litigation cases, were settled during the third National Lok Adalat of the year.

It was held across the country except for Delhi and Manipur, according to a statement.

Legal services authorities across the country, under the guidance of the National Legal Services Authority (NALSA) and the stewardship of Supreme Court judge Justice Sanjay Kishan Kaul, organised the National Lok Adalat.

Justice Kaul is also the executive chairman of NALSA.

“The approximate value of the total settlement amount in these cases is Rs 1223.90 crore. This settlement of cases will not only ease the burden of the pending cases in courts but will also control future litigation,” a statement issued by NALSA said.

In the Lok Adalat, cases involving compoundable offences, revenue cases and bank recovery cases, motor accident claims, matrimonial disputes (except divorce cases), cheque bounce cases, labour disputes and other civil cases were taken up.

“A large number of recovery matters related to financial institutions, banks, government bodies and private service providers were also taken up as pre-litigation cases, and were settled,” the NALSA statement said, adding that Justice Kaul oversaw the entire process and progress of the Lok Adalat.

Justice Kaul stressed upon the need of quick and affordable access to justice to increase the institutional participation of people and gave necessary directions to NALSA for future course of upcoming National Lok Adalats, it said.

The NALSA said that the Lok Adalats have not only proved to be an efficient substitute for redressal, but have significantly helped in reducing the burden of the Courts swiftly and in a very cost efficient manner.

Aurangabad: The Sakal Maratha Samaj on Monday said black flags will be hoisted at homes of the community from September 15 as part of a peaceful agitation for reservations in jobs and education.

“I think the Opposition, by and large, would agree with India’s current position on the conflict (between Russia and Ukraine). We have a relationship with Russia. I don’t think the Opposition would have a different position than what the Government is currently proposing, Rahul Gandhi told reporters, when he was asked to respond to rising crude oil sales to India when the West has put sanctions on Russia. India has been buying Russian crude oil at discounts.

India on several occasions maintained that its oil imports will be determined by its national interest and keeping in mind its large consumer base.

Also, India’s position has been that Russia needs to pursue the path of dialogue and diplomacy for an early resolution of the conflict.

Panel To Address Gay Community Problems, Centre Assures In Supreme Court

New Delhi: 

A committee will be formed to look into “genuine human concerns” of LGBTQIA+ community, the centre told Supreme Court today during the hearing on petitions seeking legal status for same-sex marriages.

The “human concerns” here refer to several problems faced by same-sex couples in their day-to-day life, whether it is in opening a joint bank account or in adding a partner as a nominee for an insurance policy.

Appearing for the centre, Solicitor General Tushar Mehta today said that the committee will be headed by a cabinet secretary.

The centre’s submission came after the five-judge Constitution bench, on April 27, asked the government if social benefits can be extended to same-sex couples without going into the question of legalising same-sex marriages.

The centre’s stand has been that the question of legalising same-sex marriages falls in the domain of the legislature and that the court should not intervene in the matter.

During the April 27 hearing, Chief Justice of India DY Chandrachud, who heads the bench, noted the centre’s arguments and said, “We take your point that if we enter this arena, this will be an arena of the legislature. So, now what? What does the government want to do with ‘cohabitory’ relations? And how a sense of security and social welfare is made? And to ensure that such relations are not ostracised?”

The court had made the remark after the centre contended that the “right to love, right to cohabit, right to choose one’s partner, right to choose one’s sexual orientation” is a fundamental right.

The court had then said that if the centre was accepting the right to cohabit as a fundamental right, then it has a “corresponding duty”.

“Once you recognise that the right to cohabit itself is a fundamental right… then there is corresponding duty on the State to at least recognise that the social incidents of that cohabitation must find a recognition in law. We are not going to marriage at all at this stage,” it said.

“You may or may not call it marriage but some label is necessary,” said the bench, also comprising Justice S K Kaul, Justice S R Bhat, Justice Hima Kohli and Justice P S Narasimha.

The court had referred to problems faced by same-sex couples in nominating heirs for gratuity, provident funds, and on matters related to succession and parenting.

“From that point of view we would be more than willing to have the government make a statement before us that because you have ministries dedicated for this purpose, the Ministry of Social Justice and Empowerment… Ministry of Women and Child development etc,” the court said.

The government, it said, should ensure that “these cohabiting relationships must be recognised in terms of creating conditions of security, social welfare, and to ensure, by doing that, you also ensure for the future that such relationships are not ostracised in the society.”

Hyderabad: Move to demolish Darul Uloom’s arch, main gate leads to tension

Hyderabad: Mild tension prevailed at Jamia Islamia Darul Uloom at Shivrampally on Wednesday afternoon when authorities tried to demolish the arch and main gate of the religious seminary as part of road widening works.

The management of the religious seminary opposed the move of the authorities and prevented the authorities from bulldozing the gate and main entrance arch of the seminary.

Soon Maulana Mohd Hussamuddin Sani Aqil (Jafar Pasha) reached the spot and took strong reservations over the behaviour of the authorities. “We will not allow anyone to bulldoze the gates or the arch for any purpose. Officials assured us road widening will be done without disturbing the gate or arch, now we think they backtracked,” said Jafar Pasha.

He came down heavily on the state government and administration for taking the decision to demolish the mosques and madrasas for different purposes. Jafar Pasha warned of a massive protest if the government fails to properly tackle such issues.

The authorities held a discussion with the management of the seminary and went away. Maulana Jafar Pasha asked the Muslim leadership to stand with them and raise their voice against the action of the authorities.

The Mailardevpally police reached the spot and posted a picket to prevent any trouble.

Jamia Islamia Darul Uloom Hyderabad Islamic Seminary is located at Shivrampally Road in the city. It is one of the leading educational institutions in South India and is considered one of the top Islamic educational institutions in India. It was started by the late Grand Sufi of Hyderabad Deccan, Maulana Mohammed Hameeduddin Husami Aqil in 1965.

It has a very large Library which contains historical and Islamic manuscripts. The most important attraction in this library is the copy of hand written Holy Quran of Rashidun Caliph Ht Uthman ibn Affan period.

Hyderabad: Traffic diversions were issued by the Rachakonda police in view of the IPL cricket match between Sunrisers Hyderabad and Kolkata Knight Riders on Thursday.

Traffic restrictions will be imposed between 3:30 pm and 11:30 pm in and around the Rajiv Gandhi International Stadium, Uppal.

According to the plan released, heavy vehicles from Warangal highway towards Chengicherla will be diverted at Chengicherla crossroads and sent to the Chengicherla-Cherlapalli-IOCL-NFC route.

Heavy vehicles from L B Nagar to Nagole will be diverted at Nagole metro station and sent to HMDA-Boduppal-Chengicherla crossroads while heavy vehicles from Mallapur towards Nacharam IDA will be diverted towards Cherlapalli-Chengicherla route.

Police have requested the citizens to make a note of the diversions and choose their travelling routes accordingly.

Actor Sooraj Pancholi Acquitted In Jiah Khan Death By Suicide Case

New Delhi: 

Almost a decade after actor Jiah Khan’s death by suicide, a special CBI court in Mumbai today acquitted her boyfriend and film star Sooraj Pancholi of abetment charges. Jiah Khan, 25, was found hanging at her Juhu home in Mumbai on June 3, 2013. Police later arrested Sooraj Pancholi on the basis of a six-page letter, purportedly written by Jiah, and booked him for abetment of suicide. Jiah’s mother Rabia Khan had claimed that she was killed.

Special Central Bureau of Investigation (CBI) court judge AS Sayyad directed the accused to step forward, asking 32-year-old Mr Pancholi his name, and pronounced — “Due to paucity of evidence, Sooraj Pancholi is acquitted”.

Sooraj Pancholi, the son of actor couple Aditya Pancholi and Zarina Wahab, faced a jail term of up to 10 years if convicted. His mother accompanied him to the court for the verdict.

Mr Pancholi was arrested in the case in June 2013 and released on bail in July 2013.

Jiah’s mother Rabia Khan, a key prosecution witness in the case, had told the court that she believed it to be a case of murder and not suicide. The Bombay High Court last year dismissed her petition seeking a fresh investigation into the case.

Reacting to the verdict, she reiterated that her daughter was killed. “The charge of abetment to suicide has gone. But how did my child die? This is a case of murder…will approach the high court,” she told news agency ANI, adding that the cause of Jiah’s death “has not yet been determined”.
