New Delhi: The Delhi High Court on Friday closed all the proceedings on a batch of petitions that sought direction from the Centre and the Law Commission to draft and timely implement the Uniform Civil Code (UCC) in the country and observed that the Law Commission is already working on this topic and seized of the matter.

The bench of Justice Manmohan and Justice Mini Pushkarna, after noting down the submissions, decided to dispose of the matter and said the Law Commission of India is already dealing with the issue and we cannot direct the legislature to enact a particular law.


Earlier, the Centre Government stated in its reply that it is for the legislature to enact or not to enact a piece of legislation; this is a matter of policy for the elected representatives of the people to decide and no direction in this regard can be issued by the Court.

The centre’s reply further stated that the reliefs prayed by the petitioners in the petitions are not sustainable either in law or on facts and hence are liable to be dismissed in limine as not maintainable.

The centre’s affidavit further stated that in the petition, it is submitted that only a person acting bona fide and having sufficient interest in proceedings of public interest litigation will alone have locus and may approach courts for the poor and needy suffering from violations of their statutory rights. In the present petition, there is nothing to suggest that the affected person has taken up any cause and approached the court. Hence, the present petition is not maintainable.

The affidavit also stated that the petitioner, Ashwini Kumar Upadhyay, has cited the Shah Bano Case, in which the Supreme Court has observed in favour of framing UCC. The said case does not apply to the present case on the ground that the court cannot direct the executive to enact a particular piece of legislation.
The Delhi HC was examining several similar petitions in which the court had sought the Centre’s response.

Petitions sought direction for the Law Commission to draft the UCC within three months by including the uniform minimum age of marriage; grounds of divorce, maintenance and alimony; adoption and guardianship; and succession and inheritance within three months and publish it on the website for wider public deliberation.
The petitions said that the country-wide application of UCC would end multiple personal laws promoting tolerance among various groups across the nation.
The first petition was filed by BJP leader and lawyer Ashwini Kumar Upadhyay in 2018 seeking the framing of a UCC to promote national integration and gender justice, equality and dignity for women.

Besides the five pleas, the court had earlier issued a notice to Upadhyay and the Centre on an application by the All India Muslim Personal Law Board (AIMPLB) seeking to be impleaded as a party in the petition filed by the BJP leader.

After Upadhyay, lawyer Abhinav Beri moved a similar plea for direction to the Centre to constitute a judicial commission or a high-level committee to draft the UCC.
A third petition was filed by Firoz Bakht Ahmed, the chancellor of Maulana Azad National Urdu University and grandnephew of first education minister Maulana Abul Kalam Azad, in October last year.

The fourth PIL was moved by Amber Zaidi, who claims in her plea to be a social activist and media personality. Zaidi has contended that India “urgently needs a UCC or Indian Civil Code, in the spirit of Article 44 read with Article 14” of the Constitution.She has claimed she moved the plea with the “sole purpose of securing gender justice, gender equability and the dignity of women.” The fifth petition was filed by Nighat Abbass, who claims to be a social activist, media panellist and political analyst.

The five petitions have sought directions from the Centre to constitute a judicial commission or a high-level expert committee to draft the UCC within three months while considering the best practises of all religions and sects, the civil laws of developed countries and international conventions.

All the petitioners have contended that India “urgently needs a uniform civil code” to promote national integration as well as gender justice, equality and the dignity of women.

The petitioners have contended that gender justice and gender equality, guaranteed under Articles 14-15 of the Constitution and the dignity of women, guaranteed under Article 21 of the Constitution, cannot be secured without implementing Article 44 (the State shall endeavour to secure for citizens a UCC throughout the territory of India).
The petitions have claimed that a UCC would replace the personal laws, based on the scriptures and customs of various religious communities, with a common set of rules governing every citizen of the country.

Mancherial: A tiger named K-12 has been found moving in the forests of Bellampalli and Chennur divisions for over two weeks leading to panic among rural people as also the forest department officials who suspect that the tiger faces the threat of snares set up by hunters.

The tiger is believed to have wandered into the wild of this region from the neighbouring forests in neighboring Kumram Bheem Asifabad district a few weeks ago. It killed a cow in the Kotapalli forest range after attacking two bullocks in Kushnepalli recently. The tiger’s movement in the forests triggered panic among shepherds and residents of Rampur, Kharji, Bheempur, Girivelli, and many other forest fringe villages.


However, environmentalists are concerned over the tiger’s safety in these two divisions. “Hunters lay electrified snares to kill deer, wild boars and sheep on the forest edges during winter. Such snares pose a threat to territorial animals like the tigers,” a tiger conservation activist opined.

He argued that the forest officials should take steps to divert the big cat into dense forests so that no threat is posed to it. Incidentally, the K-12 is the only tiger residing in the forests of the district. A tiger named Phalguna-II migrated from Kumram Bheem Asifabad and a four-year old male tiger entered the forests of Mancherial from Nirmal and were killed when they came in contact with electrified snares in 2017 and 2019 respectively.

District Forest Officer Shiv Aasheesh Singh said that a base camp was set up and animal trackers were deployed in addition to 48 CCTV camera traps being installed to track the tiger’s movement. Efforts are being made to ensure safe passage and to avoid threats to it. He requested the rural people to avoid sudden confrontation with it.

Forest department authorities say that in case of a tiger attack on the cattle, compensation was being paid within a month. A veterinary doctor assesses the value of the cattle killed to determine the compensation which is paid to the owner. In case the tiger kills human, the forest department pays a compensation of Rs 5 lakh and immediate relief of Rs 10,000. Similarly, an ex-gratia of Rs 75,000 is given to the victim in case of grievous injuries caused by wild animals.

Kochi:

Defence spokesperson said on Friday that the Union Defence Ministry had neither accorded nor denied landing permission for an aircraft carrying Congress leader Rahul Gandhi at the Naval airport in Kochi.

The clarification came after the Congress alleged that the Ministry of Defence denied landing permission for Gandhi’s chartered flight at the Naval facility early on Friday.

The defence spokesperson told PTI that the request for “an unscheduled chartered flight along with the flight plan” was received at INS Garuda air station at Kochi at 09.40 am on Friday and at Navy HQ at about 10.15 am for takeoff from Kannur Airport at 10.45 am.

“Due to the delayed request and paucity of time prior to the departure of the flight, the clearance for the same could not be processed,” he told PTI.

Earlier in the day, Ernakulam DCC president Mohammed Shiyas alleged that the Defence Ministry had initially granted permission for the aircraft’s landing at the Naval facility but later withdrew it.

Consequently, the aircraft carrying Mr Gandhi from Kannur was directed to the Cochin International Airport Limited (CIAL) in nearby Nedumbassery, he had said.

Hyderabad records 47.88 polling percentage


Hyderabad: Continuing the string of low polling percentages in the district, Hyderabad recorded 47.88 per cent polling on Thursday, with only 6 out of 15 constituencies crossing the 50 per cent mark.

Of the 45.36 lakh registered electors, only 21.72 lakh (11.29 lakh male voters, 10.42 female and 65 others) turned up to vote.


The highest polling percentage was recorded in Goshamahal with 55.38, and lowest polling was in the Yakutpura constituency with 39.64 per cent. Except for Jubilee Hills, Nampally, and Secunderabad Cantonment, other 12 constituencies saw a decline in voter turnout, while Charminar saw a 7.05 per cent decline in voter turnout.

With only a 45.50 polling percentage, Bahadurpura saw over five per cent decline. The same was the case in 2018 assembly elections when the constituency recorded 50.39 per cent, five per cent less than 2014 assembly elections 55.85 per cent.

SCR reviews preparedness for ‘Michaung’ Cyclone


Hyderabad: Additional General Manager, South Central Railway (SCR), R.Dhananjayulu, held a review meeting with Vijayawada, Guntur and Guntakal division officials on the impending ‘Michaung’ cyclone and the various steps being taken by the railways to tackle it.

He reviewed the position of monsoon reserve stock at various depots and directed the officials for judicial deployment of the stock at different places, and closely monitor the path of the cyclone for undertaking necessary measures. He also advised officials to closely liaison with the State government for monitoring the position of railway affecting tanks in the section to ensure safety of track and train operations.


He further directed to ensure monsoon patrolling of the tracks in the likely affected sections. Stationary watchmen are also being posted at all vulnerable bridges and locations to get real time information.

Advisory to rail passengers:

In view of the cyclonic weather conditions prevailing in the South Coastal region of Andhra Pradesh and Tamil Nadu due to the impending severe cyclonic storm, there is a likelihood of change in the pattern of train services in this region in the next couple of days in the interest of safety to the train operations and passengers.

The possibility of heavy rains along with high speed winds in the coastal region over the zone may affect the train operations.

The train services scheduled to be run in the affected sections is likely to be altered during this period. They are likely to be diverted, rescheduled, partially cancelled or cancelled as per the demands of the situation.

Passengers are requested to plan their rail journeys keeping in view the above factor and may check from the railway authorities about the actual position of the running of the trains before undertaking their journey.

Hyderabad: The Kaloji Narayana Rao University of Health Sciences (KNRUHS) has directed faculty (doctors) in private and government teaching hospitals not to hold private practice during institutional working hours between 9 am and 4 pm.

A KNRUHS on Friday issued a notice to the principals of private and government medical and dental colleges in Telangana said, “the National Medical Commission (NMC) has advised the heads of the medical colleges to instruct their respective teaching faculty to not to practice during their institutional hours.”


On its part, the Telangana State Medical Council (TSMSC) issued a similar notice on November 16 to the principals of private and government medical colleges, instructing them that faculty members should avoid private practice during institutional hours.

“The Medical Council is bringing to the notice of all the Medical Colleges (both private and government) and cautions staff working under their control. They may be warned that if any faculty doctor is found practicing during their working hours it is deemed to violating of code of medical ethics and their registration numbers will be removed from the medical registry of TSMC, Hyderabad,” the notice said.

Hyderabad: The Jawaharnagar police booked Mynampally Hanumanth Rao, the Congress MLA candidate from Malkajgiri assembly constituency, and his supporters for allegedly abusing and assaulting a Bharat Rashtra Samithi (BRS) party leader on Friday.

Police said Hanumanth Rao and his supporters picked up an argument with Karamchand, a local senior BRS worker at a polling booth in Yapral over a trivial matter and abused and assaulted him during the polls on Thursday.


Based on a complaint on Friday, a case was booked under various sections and being investigated.

WHO says 'extremely concerned' as Gaza hospitals like a 'horror movie'

The World Health Organization warns that the Gaza Strip cannot afford to lose more hospitals as the health care system there was already “catastrophic,” with hospitals resembling a “horror movie” even before Israel resumed its attacks on the besieged Palestinian territory.

Israel resumed its brutal bombing campaign on the Gaza Strip after a week-long truce, early on Friday.

WHO’s representative in the Palestinian territories Richard Peeperkorn told reporters in Geneva via video-link from Gaza that “the health system in Gaza has been crippled by the ongoing hostilities.”

“We are extremely concerned about the resumption of violence,” he said adding that Gaza “cannot afford to lose more hospitals.”

Peeperkorn said only 18 of Gaza’s 36 hospitals are even minimally to partially functional, with the three main hospitals in the north barely operative.

In the south of Gaza, 12 hospitals are partially functional but are “extremely overwhelmed,” he said.

All the hospitals were suffering shortages of supplies, fuel, food and even water, Peeperkorn said, adding that there was an “urgent need” for a sustained flow of aid “to keep them functional.”

Hospital bed capacity across Gaza has fallen from 3,500 to just 1,562 even as needs have skyrocketed, he said, adding that at least 5,000 beds were needed.

The truce, which was extended twice, had paused Israel’s relentless attacks on the besieged territory on November 24. 

The week-long ceasefire saw the release of 105 Israeli captives held in Gaza and 240 Palestinian prisoners. It also allowed some humanitarian aid into Gaza but the aid supplies were far below what is needed, according to aid workers.

Meanwhile, a WHO senior emergency officer Rob Holden, who was speaking via video-link from Gaza, told reports in Geneva that as Israel has resumed bombing of the populated territory, medics are expected to be grappling with “the most horrific scene” in the hospitals.

He said that “casualties probably in their tens if not hundreds turn up at” a relatively small hospital, which he visited days before in Gaza City.

Holden said he and other WHO staff had in recent days visited the Al Ahli Hospital, which he described as a “horror movie.”

Patients were covering the floor “with the most traumatic injuries that you can imagine,” he said, adding, “The floor is just awash with blood and patients lying waiting to receive life-saving care.”

Holden also said that hospital staff were struggling to deal with the growing number of dead. “It is done with the best possible dignity but still the bodies are lined up in the car park outside.”

He also warned that Gaza “healthcare service is on its knees.”

Gaza health ministry confirmed on Friday that more than 109 people lost their lives after the regime began bombing the territory again.

Spokesman Ashraf al-Qudra said in a statement that hundreds have been wounded in the Israeli aggression.

Israel waged its war on Gaza on October 7 after Hamas launched an operation against the occupied territories on that day in response to the Israeli regime’s decades-long campaign of bloodletting and devastation against Palestinians.

The regime has so far killed more than 15,000 people, including over 5,000 children.
