Washington: Google will confront a threat to its dominant search engine beginning Tuesday when federal regulators launch an attempt to dismantle its internet empire in the biggest US antitrust trial in a quarter century.

Over the next 10 weeks, federal lawyers and state attorneys general will try to prove Google rigged the market in its favour by locking its search engine in as the default choice in a plethora of places and devices.

US District Judge Amit Mehta likely won’t issue a ruling until early next year. If he decides Google broke the law, another trial will decide what steps should be taken to rein in the Mountain View, California-based company.

Top executives at Google and its corporate parent Alphabet Inc, as well as those from other powerful technology companies are expected to testify. Among them is likely to be Alphabet CEO Sundar Pichai, who succeeded Google co-founder Larry Page four years ago. Court documents also suggest that Eddy Cue, a high ranking Apple executive, might be called to the stand.

The Justice Department filed its antitrust lawsuit against Google nearly three years ago during the Trump administration, charging that the company has used its internet search dominance to gain an unfair advantage against competitors.

Government lawyers allege that Google protects its franchise through a form of payola, shelling out billions of dollars annually to be the default search engine on the iPhone and on web browsers such as Apple’s Safari and Mozilla’s Firefox.

Regulators also charge that Google has illegally rigged the market in its favor by requiring its search engine to be bundled with its Android software for smartphones if the device manufacturers want full access to the Android app store.

Google counters that it faces a wide range of competition despite commanding about 90% of the internet search market. Its rivals, Google argues, range from search engines such as Microsoft’s Bing to websites like Amazon and Yelp, where consumers can post questions about what to buy or where to go.

From Google’s perspective, perpetual improvements to its search engine explain why people almost reflexively keep coming back to it, a habit that long ago made “Googling” synonymous with looking things up on the internet.

The trial begins just a couple weeks after the 25th anniversary of the first investment in the company — a $100,000 check written by Sun Microsystems co-founder Andy Bechtolsheim that enabled Page and Sergey Brin to set up shop in a Silicon Valley garage.

Today, Google’s corporate parent, Alphabet, is worth $1.7 trillion and employs 182,000 people, with most of the money coming from $224 billion in annual ad sales flowing through a network of digital services anchored by a search engine that fields billions of queries a day.

The Justice Department’s antitrust case echoes the one it filed against Microsoft in 1998. Regulators then accused Microsoft of forcing computer makers that relied on its dominant Windows operating system to also feature Microsoft’s Internet Explorer — just as the internet was starting to go mainstream. That bundling practice crushed competition from the once-popular browser Netscape.

Several members of the Justice Department’s team in the Google case — including lead Justice Department litigator Kenneth Dintzer — also worked on the Microsoft investigation.

Google could be hobbled if the trial ends in concessions that undercut its power. One possibility is that the company could be forced to stop paying Apple and other companies to make Google the default search engine on smartphones and computers.

Or the legal battle could cause Google to lose focus. That’s what happened to Microsoft after its antitrust showdown with the Justice Department. Distracted, the software giant struggled to adapt to the impact of internet search and smartphones. Google capitalised on that distraction to leap from its startup roots into an imposing powerhouse.

Earlier, the Delhi High Court had ordered Spicejet to pay Rs 100 Crore by September 10.

SpiceJet has completed the payment of Rs 100 crore to Kal Airways Private Limited, the airline confirmed in a statement today. While a payment of Rs 77.5 crore had been made to Kal Airways till September 11, the remaining Rs 22.5 crore was paid on Tuesday.

The Delhi High Court on Monday had directed Spicejet and its chairman and managing director (CMD), Ajay Singh, to make an RTGS transfer before 4 pm on Tuesday while hearing a plea moved by Kal Airways stating that the order passed by the Court was not being complied with.

They had only paid 62.5 crore to Kal Airways and Kalanithi Maran on September 8 and the amount of 37.5 crore was still remaining, stated the Senior Advocate who appeared for Kal Airways.

Delhi High Court’s Order To SpiceJet

Earlier, the Delhi High Court had ordered Spicejet to pay Rs 100 Crore by September 10.

Maninder Singh, senior advocate, instructed by Nandini Gore. senior partner; Sonia Nigam, principal associate and Yash Dubey, and Akarsh Sharma, associate advocates from Karanjawala & Co; appeared on behalf of Kal Airways Pvt. Ltd. and Kalanithi Maran and Amit Sibal, a senior advocate appeared on behalf of Spicejet Ltd. and Ajay Singh in the matter.

The division bench of the Delhi High Court recently refused to stay a single bench order upholding the arbitral tribunal’s order directing SpiceJet and its chairman and managing director to refund over Rs 270 crore to Sun Group promoter Kalanithi Maran and Kal Airways.

Meanwhile, the division bench had issued notice on the appeal challenging the single bench order.

SpiceJet and its CMD had filed an appeal before the division bench of Delhi High Court challenging a single judge’s order directing them to refund over Rs 270 crore to Kalanithi Maran and Kal Airways.

The bench of Justice Chandra Dhari Singh on July 31 while pronouncing the judgment in Section 34 petition moved by the parties, affirmed the Arbitral Award dated 20.07.2018 passed by an Arbitral Tribunal comprising 3 retired Supreme Court Judges in favour of Kal Airways and Kalanithi Maran.

The Arbitral Award directed that Decree Holders  — Kal Airways and Kalanithi Maran — were entitled to a refund of Rs.308 crores towards the Warrants and a refund of the amount of Rs.270 crores towards Cumulative Redeemable Preference Shares (CRPS).

Further, Kal Airways and Kalanithi Maran were also awarded an interest of 12 per cent towards Pendente lite and another 18 per cent from the last date of the due date in terms of the Arbitral Award in case the payments, as directed to be made by Spicejet and Ajay Singh, is not made within two months from the date of award.

Spicejet and Ajay Singh had filed section 34 Petitions challenging the Arbitral Award, and the direction of a refund to the tune of Rs 270 crores to Kal Airways and Kalanithi Maran, and praying that it be set aside.

Spicejet and Ajay Singh had further sought the setting aside of the award seeking a waiver of 12 per cent interest towards warrants as well as setting aside the interest of 18 per cent granted under the award on both warrants and CRPS.

Kal Airways and Kalanithi Maran also filed Section 34 Petition seeking setting aside of award to the extent no interest was granted on the amount of Rs 270 crores, as well as damages for non-issuance of Warrants and CRPS.

The Red Cross appealed on Tuesday for more than $100 million to provide desperately needed assistance in Morocco, days after a powerful earthquake killed nearly 2,900 people.

“We are seeking 100 million Swiss francs ($112 million) to be able to deliver on the most pressing needs at this time,” Caroline Holt, global director of operations at the International Federation of Red Cross and Red Crescent Societies (IFRC), told reporters in Geneva.

She said the funds were needed for “health, water, sanitation and hygiene, shelter relief items and basic needs”, stressing: “We need to make sure we avoid a second wave of disaster.”

Search and rescue teams from Morocco and abroad continued on Tuesday to dig through the rubble of broken mud-brick homes, hoping for signs of life in a race against time.

Friday’s 6.8-magnitude quake was the most powerful in Morocco on record.

It was the most deadly to hit the North African country since a 1960 earthquake destroyed Agadir on the Atlantic coast, killing between 12,000 and 15,000 people.

Overall, at least 2,862 people have died and more than 2,500 have been injured in the latest tragedy, according to an official toll issued late on Monday.

Morocco has authorised rescue teams to come to its aid from Britain, Qatar, Spain, and the United Arab Emirates but has so far declined offers from several other nations, including the United States and Israel.

Holt on Tuesday defended the seemingly slow pace at which the kingdom was welcoming in more international aid.

“This is an overwhelming event… This would have overwhelmed many societies,” she stressed.

“Coordination and careful consideration at this moment in time is key,” she said. 

“(It is) extremely complex accessing these hard to reach areas the needs are still evolving.”

“So I think that the Moroccan government is taking careful steps with regard to opening up and accepting bilateral offers of support … (and is) focusing on that search and rescue window before that window, unfortunately, closes, which is certainly in the coming hours.”

An anti-corruption court cited “security” as it rejected a house custody plea for jailed ex-Andhra Pradesh Chief Minister Chandrababu Naidu, who will now spend the rest of his two-week remand period in jail, unless he gets relief in the form of bail. On Tuesday Mr Naidu had been sent to judicial custody after he was arrested in connection with an alleged multi-crore scam.

The court in Andhra Pradesh’s Vijayawada rejected arguments from Mr Naidu’s legal team and his wife, who spoke of her “worry for his safety inside jail”. “I did not see any special arrangements made for him,” she told reporters after the court refused to quash Mr Naidu’s remand order.

“I felt I left a part of me inside. They have tied him up in the building he helped construct,” she said.

Mr Naidu’s wife, Bhuvaneswari; his son, Lokesh; and his daughter-in-law, Brahmani; met the former Chief Minister at the jail in Rajahmundry, to which he was taken on Sunday. Bhuvaneswari called on workers from her husband’s Telugu Desam Party to speak out and support him.

“Not just TDP cadre… but the people need to stand up for Mr Naidu, who always put the welfare of the people before that of his family. I give you my word that the TDP, established by Nandamuri Taraka Rama Rao (who is her father), is here to stay,” she declared.

The TDP founder, referred to by his initials – NTR – invoked Telugu pride to establish his party as a force to be reckoned with in a short period of time.

Earlier today, actor-politician Balakrishna – a party lawmaker from Hindupur and NTR’s son, said it was time for the people to “throw out” Andhra Pradesh Chief Minister Jagan Mohan Reddy. “No need to be afraid of anyone. I am coming… will show them valour and strength of Telugu people.”

Meanwhile, the Andhra Pradesh Police’s Crime Investigation Department has sought five-day custody of Mr Naidu, arguing they need to interrogate him as the alleged is a serious economic offence and as the “prime conspirator”, Chandrababu Naidu, had “full knowledge” of events.

The multi-crore scam deals with money allocated to the Department of Skill Entrepreneurship and Innovation by the state, and incorporated into the 2015-16 budget.

According to the CID, inquiries revealed serious irregularities, specifically, before any expenditure by private entities, the then government provided an advance of Rs 371 crores, representing the entire 10 per cent commitment by the government.

Most of the money advanced was diverted to shell companies through fake invoices, with no actual delivery or sale of items mentioned in invoices, officials said.

CID officials have also said senior government officials, including then chief secretary IYR Krishna Rao, made notings in related files. They had objected to the advance release of funds to Design Tech and noted that this was being done on the instructions of N Chandrababu Naidu.

Retail inflation declined to 6.83 per cent in August compared to July, mainly due to easing food prices, according to official data.

The Consumer Price Index (CPI) based inflation was at 7.44 per cent in July and at 7 per cent in August 2022, as per the data released by the National Statistical Office (NSO) on Tuesday.

Food inflation eased to 9.94 per cent in August from 11.51 per cent in July.

The Reserve Bank of India (RBI) has projected the CPI inflation at 5.4 per cent for 2023-24.

SC refuses to entertain Asaram Bapu’s plea seeking bail, suspension of sentence in rape case



New Delhi: The Supreme Court on Tuesday refused to entertain a plea filed by self-styled godman Asaram Bapu against the Rajasthan High Court order rejecting his application for suspension of sentence in connection with the rape case of a minor girl.

A bench of Justices Sanjiv Khanna and S.V.N. Bhatti dismissed the bail plea as withdrawn.

However, the bench granted liberty to the petitioner to move a fresh application before the high court for releasing him on bail till his appeal against trial court’s conviction order is decided.

The Rajasthan High Court in July last year had rejected the accused plea seeking suspension of sentence till disposal of the pending appeal. It had said that the defence has sought multiple adjournments in the past and two previous applications for suspension of sentence have been dismissed.

Asaram has been serving life imprisonment in Jodhpur prison following his conviction under the Protection Of Children from Sexual Offences (POCSO) Act and other offences by a trial court in 2018. He has already suffered incarceration for over ten years. The accused continues to be in custody in another trial in Gujarat.

The Gandhinagar court in Janury this year sentenced him to life imprisonment for raping a prosecutrix between 1997 to 2006 in Ahmedabad.

Greek soldiers evacuated local residents from the flooded town of Palamas on Friday (September 8) in the aftermath of Storm Daniel in Greece.

Hundreds of people were stranded without food or water for a third day in Greece after a devastating rainstorm killed at least six people and caused billions of euros of damage.

Storm Daniel, which meteorologists said was the worst to hit the country since records began in 1930, has left a trail of devastation in central Greece.

Homes were swept away by torrents, bridges collapsed, roads were made impassable, power lines fell and crops in one of Greece’s main agricultural breadbaskets wiped out.
