Ranchi: A National Investigation Agency (NIA) court here has sentenced two persons to 15 years rigorous imprisonment in a CPI (Maoist) arms and ammunition seizure case of 2012. Prafulla Malakar of Patna district has been sentenced to different jail terms and fines and the court has similarly pronounced varying quantum of sentence against Anil Kumar Yadav of Gaya district, according to a statement issued by the NIA.

The maximum of 15 years rigorous imprisonment has been awarded to both the accused under Section 25(1-AA)/35 of Arms Act, it said, adding that all the sentences will run concurrently. The case relates to Hazaribagh in Jharkhand where police arrested Malakar from Silodar Forest near Chauparan in August 2012.

Police seized one US-made M-16 rifle, 14 live rounds, two mobile phones, and one bullet proof jacket from Malakar, a member of the arms and ammunition supply unit of the banned terror organisation, CPI (Maoist), the statement said. Further investigation led to the arrest of Yadav, a Zonal Commander of CPI (Maoist) who had come to collect or buy the weapons from Malakar, it said.

Police seized Rs 9 lakh cash, two mobile phones, one 9 mm pistol and two live rounds from Yadav’s possession, the statement added. NIA, which took over the case from the local police on December 17, 2012, filed supplementary charge sheets against Malakar and Yadav, as well as another accused Mantu Sharma.

PCB Chief's Sharp Retort At Gillespie Over "Utterly Blindsided" Remarks

Pakistan Cricket Board (PCB) chairman Mohsin Naqvi has cleared the air on Jason Gillespie‘s resignation as head coach of the Test team. The former Australia pacer Gillespie stepped down from his role earlier this month after PCB decided not to extend high performance coach Tim Nielsen’s contract. Gillespie was also upset over the fact that the PCB had also barred the coaches from having a say in the selection matters, a decision which had led to the ouster of white-ball coach Gary Kirsten.

“There were certainly challenges. I went into the job eyes wide open, I want to make that really clear. I knew that, you know, Pakistan had cycled through a number of coaches in a pretty short space of time. The straw that broke the camel’s back, I suppose, was, as a head coach, you like to have clear communication with your employer. I was completely and utterly blindsided by a decision to not have a high-performance coach,” Gillespie had told ABC Sport following his resignation.

With Pakistan set to take on South Africa in a two-match Test series, starting from Boxing Day, PCB chief Naqvi has shared his views on Gillespie’s sudden departure.

“The head coach’s role is to coach the team, while the selection committee is supposed to select players,” Naqvi told Geo News.

Both Gillespie and Kirsten were appointed on a two-year contract before the T20 World Cup 2024 and the PCB had promised a new era for the Pakistan team.

But once Aaqib Javed was brought in as senior selector and PCB granted him full powers including in team selection, the foreign coaches started falling out with the board.

Javed has also been appointed as the interim coach of the team across all three formats.

Pakistan lost the T20I series against South Africa, before turning the tables in the ODIs.

1 Dead As Brazil Bridge Collapses, Truck Carrying Acid Falls Into River

A bridge connecting two states in Brazil’s northern and northeastern regions collapsed on Sunday as vehicles were crossing, killing at least one person and spilling sulfuric acid into the Tocantins River.

The National Department of Transport Infrastructure said the central span of the 533-meter (0.3-mile) bridge, linking the cities of Estreito in Maranhao state and Aguiarnopolis in Tocantins state, gave way in the afternoon. A tanker truck carrying the acid plunged into the water, officials said.

According to the fire department, one person has been confirmed dead and another was rescued alive.

Aguiarnopolis city councilman Elias Junior was recording a video asking authorities to fix problems with the bridge, which he said could no longer handle the heavy trucks passing over it. As he pointed to a large crack on the shoulder of the bridge, the structure collapsed in front of him, causing him to run back. Reuters could not immediately independently verify the video. Junior did not immediately respond to a request for comment.

Preliminary estimates indicate at least 11 people were involved in the accident with two trucks, a car, and a motorcycle falling into the river, which is more than 50 meters (164 feet) deep.

By early evening, rescue divers halted their efforts after identifying that one submerged tanker was leaking sulfuric acid, said the fire department from Tocantins.

The Juscelino Kubitschek de Oliveira Bridge, inaugurated in 1960, was built with reinforced concrete and is part of the BR-226 highway, connecting the federal capital Brasilia to Belem, a northern city set to host the United Nations Climate Change Conference next year.

Shield Constitutional Bodies From Political Influence: Top Court Judge

India Must Shield Constitutional Bodies From Political Influence: Supreme Court Judge

Bengaluru:

India must protect the integrity of its constitutional institutions from outside interference, including those that are politically motivated, said Justice PS Narasimha, Judge, Supreme Court of India, on Sunday.

Justice Narasimha was delivering the Justice ES Ventakaramiah Centennial Memorial Lecture, organised by the National Law School of India University (NLSIU) in Bengaluru.

Justice Venkataramiah served as the 19th Chief Justice of India. He previously served as a judge of the Karnataka High Court, as well as the Advocate General of Mysore. According to the Supreme Court Observer, he was a part of benches that pronounced 720 judgments. Of these, he authored 256 judgments during his term at the Supreme Court.

In his lecture, Justice Narasimha said integrity of the institutions can be maintained only by putting in place safeguards in the appointment, decision making and removal process of individuals who helm these institutions.

He also added that the topic of the memorial lecture, ‘Reimagining Constitutional Institutions: Integrity, Efficiency, and Accountability’ is relevant, as Justice Venkataramiah belonged to that generation of judicial statesmen who played an active role in developing and sustaining institutions.

Justice Narasimha dwelled in detail about the role of ‘Fourth Branch Institutions’ like the Election Commission, the Comptroller and Auditor General of India, Union and State Public Service Commissions, and the National Commissions for SCs, STs, and OBCs.

Giving the example of the Election Commission, for instance, the justice said, “Today, we take it for granted that there is a separate body outside the executive to hold elections for Parliament and state legislatures.

However, it is important to recognise that before its institutionalisation, it was possible for elections to be conducted through the executive branch,” said the judge.

He lauded the vision of India’s constitution-makers who chose to institutionalise the superintendence, direction and control of elections through a body outside the Executive.

“I am amazed by the foresight of our constitution makers to provision sub-article (2) to Article 324 to enable appointment of such number of Election Commissioners, over and above the Chief Election Commissioner, to constitute the Commission,” said Justice Narasimha.

He went on to add that the non-constitutional fourth branch institutions like the Central Vigilance Commission and the Central Information Commission, can also be categorised under ‘integrity institutions’, which should be insulated from political influence.

He also said our Constitution is not a mere legal document, but an instrument of social change. He said it has clearly demarcated constitutional spaces for the traditional three branches the executive, the legislature, and the judiciary.

“There is the occasional trespass, if I may use that term; there is a contestation as to the custody of Constitutional spaces, but that only underlines that there is a system of checks and balances,” he added.

According to him, these checks and balances are put in place by the ‘Fourth Branch institutions’. “We need other institutions or procedures which can make the traditional branches accountable, accessible and open to the citizenry.” We need institutions that can withstand political tribulations, hold power wielding officials accountable and ensure a smooth democratic process,” said the judge.

He also talked about how the citizenry is entitled to ask questions at the traditional branches and receive replies in an accountable manner.

“The Information Commissions constituted under the RTI Act is also body of immense constitutional significance as it further ensures accountability and transparency in government functioning by creating a mechanism for citizens to access information from public authorities,” said the justice.

Adding that their independence from the government is a hallmark of their functioning, Justice Narasimha said, for this, the RTI Act secures the appointment, tenure, conditions of service, and removal of their officers.

Despite the importance of ‘integrity institutions’, Justice Narasimha said as citizens we have glossed over the significance and underestimated the capacity and relevance of these institutions.

“There is hardly any discussion, reflection and scholarship on public institutions. Importantly, we have collectively failed to re-invigorate and recast some of our institutions which are stuck in an analogue mode in a digital world,” he added.

He also highlighted the tasks that lie ahead of us as a constitutional democracy, like fixing infrastructural and enforcement failures, as well as lack of autonomy.

“My attempt today was only to kindle a serious conversation around how our institutions work. A conversation which I hope will be sustained one ‘not just in terms of legal scholarship, but also which will contribute to the actual working of our democratic Constitution,” added Justice Narasimha.

Can Elon Musk Become US President? Donald Trump Says…

Could Elon Musk, who holds major sway in the incoming Trump administration, one day become president? On Sunday, Donald Trump answered with a resounding no, pointing to US rules about being born in the country.

“He’s not gonna be president, that I can tell you,” Trump told a Republican conference in Phoenix, Arizona.

“You know why he can’t be? He wasn’t born in this country,” Trump said of the Tesla and SpaceX boss, who was born in South Africa.

The US Constitution requires that a president be a natural-born US citizen.

Trump was responding to criticism, particularly from the Democratic camp, portraying the tech billionaire and world’s richest person as “President Musk” for the outsized role he is playing in the incoming administration.

As per ceding the presidency to Musk, Trump also assured the crowd: “No, no that’s not happening.”

The influence of Musk, who will serve as Trump’s “efficiency czar,” has become a focus point for Democratic attacks, with questions raised over how an unelected citizen can wield so much power.

And there is even growing anger among Republicans after Musk trashed a government funding proposal this week in a blizzard of posts — many of them wildly inaccurate — to his more than 200 million followers on his social media platform X.

Alongside Trump, Musk ultimately helped pressure Republicans to renege on a funding bill they had painstakingly agreed upon with Democrats, pushing the United States to the brink of budgetary paralysis that would have resulted in a government shutdown just days before Christmas.

Congress ultimately reached an agreement overnight Friday to Saturday, avoiding massive halts to government services.

Kohli Labelled 'Bully' Over Argument With Female Reporter: "Berated Her…"

Star India batter Virat Kohli has been labelled as “bully” after his recent argument with a female journalist earlier this week. This comes after Kohli lashed out at Nat Yoannidis, a local journalist upon landing with his family at the Melbourne Airport. Kohli was seemingly unhappy with the journalist for filming his kids without his permission, citing privacy concerns. The 36-year-old had also warned Indian journalist in the past, against clicking pictures of his son and daughter. However, this rule doesn’t apply in Australia as the journalist are free to record and click pictures of the celebrities.

Kohli urged the journalist to delete the images and videos of his kids, but asked her to keep his solo ones. He was also seen shaking hands with the journalists upon getting assurance that they were not filming his kids.

Now, a Nine Sports journalist has lashed out at Kohli, labelling the former India captain as a “bully”. He slammed Kohli for “berating” the female reporter.

“Nat was out there with a cameraman, a Channel 7 reporter was out there with his cameraman and they were doing what we do on a daily basis essentially, and that’s be at the airport to actually get identities, whether they’re politicians, whether they’re sporting identities or whatever. He took umbrage, he being Virat Kohli, to the fact the cameras were focused on him,” Jones was quoted as saying by Daily Mail.

“Well duh! You’re a batting superstar, you’re a global superstar in the world of cricket, and he takes umbrage to the fact that the attention is focused on him. What really got my back up when I saw the footage was that he turned around to the three blokes, the two cameramen and the reporter from Channel 7, and said you guys are OK, it’s her,” he added.

“Really? Big tough man, Virat. And then he stood over this girl, Nat Yoannidis, who’s about five foot one, five foot two, and just absolutely berated her. You’re nothing but a bully, Virat,” a fuming Jones said.

Haiti gang massacres at least 110 people in Cite Soleil: Rights group

At least 110 people were killed over the weekend in Haiti’s Cite Soleil slum when a gang leader targeted elderly people he suspected of causing his child’s illness through witchcraft, the National Human Rights Defense Network (RNDDH) said on Sunday.

All the victims were aged over 60, the rights group said.

Wharf Jeremie gang leader Monel “Mikano” Felix ordered the massacre after his child became sick, RNDDH said, saying that he sought advice from a Voodoo priest who accused elderly people in the area of harming the child through witchcraft.

Gang members killed at least 60 people on Friday and 50 on Saturday using machetes and knives, it said.

Cite Soleil, a densely populated slum by the port of the capital Port-au-Prince, is among the poorest and most violent areas of Haiti.

Tight gang control, including the restriction of mobile phone use, has limited residents’ ability to share information about the massacre.

Felix, who heads the Wharf Jeremie gang, was in 2022 banned from entering neighboring Dominican Republic.

Felix’s child died on Saturday afternoon, RNDDH said.

The United Nations in October estimated that Felix’s gang numbered some 300 people and also operated around nearby Fort Dimanche and La Saline.

La Saline was in November 2018 the site of the massacre of at least 71 civilians, while hundreds of homes were set on fire.

Jimmy “Barbecue” Cherizier, the face of the Viv Ansanm alliance of gangs across Port-au-Prince, has been sanctioned by the United Nations on charges of planning the La Saline massacre while he was still a police officer, among other crimes.

In October, at least 115 people were massacred in Pont-Sonde, a town in Haiti’s breadbasket  Artibonite region, in

what the Gran Grif gang said was retaliation for residents working with a self-defense group hindering their road toll operations.

The government, wracked by political infighting, has struggled to contain armed gangs’ growing power in and around the capital.

Haitian authorities had in 2022 requested international security support for local police, but the mission – based on voluntary contributions – that the United Nations approved in 2023 has only partially deployed and is severely under-resourced.

Haitian leaders have since called for the mission to be converted into a UN peacekeeping force to ensure it is better supplied, but the plan remains stalled.

"Saw Several Of Our Boys Crying": Pak Star On Loss To India In Asia Cup

Pakistan batter Imam-ul-Haq has shared an insight into how a defeat to India terribly affected the mentality of Pakistan players leading up to the 2023 ODI World Cup. Imam speaks about the 2023 Asia Cup, where Pakistan were handed a humiliating 228-run defeat by India, thereby also ending their hopes of winning the Asia Cup. In that game, Pakistan were bowled out for just 128, chasing India’s 356. Imam narrated the raw emotions of how that game, and then the loss to Afghanistan during the World Cup, completely shattered the confidence of the Pakistan team.

“The sudden loss to India in the Asia Cup (in 2023) started a downfall. The Asia Cup was a disaster. I saw several of our boys crying, a lot of them locked themselves in their rooms and many of them had stopped smiling,” narrated Imam on the Ultra Edge Podcast.

Following the defeat to India in the Asia Cup, Pakistan were again comprehensively beaten by India in the 2023 ODI World Cup. A few days later, Pakistan’s hopes of qualifying were almost dashed when they were beaten by Afghanistan as well. Imam said that these losses badly affected his teammates.

“I remember the exact picture after the Afghanistan match. Where I was sitting, where Babar (Azam) was, Haris (Rauf) and Shaheen (Afridi) were sitting in front of me and one of them was bitterly crying. Shadab (Khan) was sat in a corner,” Imam said.

“The downfall started from the India game, and after the Afghanistan loss, it was the end for us,” Imam said further.

Pakistan went on to miss qualification to the semi-finals of the World Cup, leading to Babar Azam resigning from captaincy. Although he was reinstated six months later, Pakistan’s poor white-ball form continued as they got knocked out of the T20 World Cup 2024 in the initial group phase. This led to Babar quitting captaincy permanently.

Pakistan are experiencing a renaissance since then, having won back-to-back ODI series, in Australia and South Africa respectively, under the leadership of Mohammed Rizwan.
