Allahabad HC stays demolition of house in Prayagraj

Prayagraj: The Allahabad High Court has stayed the demolition of a house in the Dal Mandi area, whose owner was asked by the Varanasi municipal corporation to demolish it within a week due to its dilapidated condition.

The bench comprising Justice Neeraj Tiwari and Justice Siddharth Nadan passed the order in a petition filed by Syed Abbas Murtaza Shamsi. Senior Advocate, SFA Naqvi, appearing for the petitioner, argued that the petitioner’s house no. 39/12 was not mentioned in a list of dilapidated buildings of January 30, 2026, but all of a sudden, a demolition notice was sent on April 15, 2026, in the name of a deceased, Shamshu Nisha Begum, rendering the whole process void from the beginning.


The court in order dated April 30 directed advocate for the municipal corporation to produce before it an inspection report of the area dated April 15, 2026 on the basis of which the demotion notice was passed.
The court directed to list this case afresh on May 7, 2026 and till then, status quo shall be maintained and no demolition shall take place.
